GENERAL

Protecting your personal data and safeguarding your privacy are very important to us. We handle your personal data sensitively and carefully and ensure a high level of data security.

We are committed to handling your personal data responsibly and therefore consider it a matter of course to comply with the Swiss Federal Act on Data Protection (FADP), the associated ordinances (DPO) and other applicable data protection regulations, in particular the European General Data Protection Regulation (GDPR). According to these provisions, every person is entitled to protection of their privacy and protection against misuse of their personal data.

In cooperation with our hosting providers, we endeavour to protect the databases as well as possible against unauthorised access, loss, misuse or falsification. As the operator of this website, we adhere to the principle of ‘privacy by design’, which is why all data traffic is encrypted end-to-end. Personal data is treated as strictly confidential and is neither sold nor passed on to third parties.

We would like to point out that, depending on the security and configuration of the end devices and user behaviour, data transmission on the Internet can be compromised and have security gaps (e.g. e-mail communication without encryption). Complete protection of data against unauthorised access by third parties is not possible.

By using the website, you consent to the collection, processing and use of data in accordance with the following description.

2. Personal data

Personal data is information that makes it possible to identify a natural person. This includes, in particular, name, date of birth, address, telephone number, e-mail address and the IP address of your end device. Anonymous data always exists when no reference can be made to a person.

In this privacy policy, we describe how we collect and process personal data when you visit this website, use our applications or utilise our services. Processing is understood to mean any handling of data, regardless of the means and procedures used, including reading, obtaining, disclosing, using, storing, transferring or modifying and deleting data (Art. 5 lit. d and e FADP).

If personal data (e.g. name, address or email address) is collected on our website, this is always done on a voluntary basis. This data will not be passed on to third parties without your express consent. We process personal data for the duration required for the respective purpose(s). In the case of longer-term storage obligations due to legal and other provisions to which we are subject, we restrict the processing accordingly or, if technically possible, we store the data in encrypted form.

2.1 Visit the Website

When you visit our website, a modal window with a note on the use of cookies is displayed. Cookies are only set or scripts executed after your confirmation by clicking on the ‘Accept’ button (for more information on cookies, see section 4).

This allows you to block all types of cookies and scripts. This means that the presentation of the website is not optimised and individual functions cannot be used (e.g. community pages).

Our website can generally be visited without registration. When you access our website, the following technically necessary data is temporarily stored in so-called server log files, without this data being able to be directly linked to your person:

  • IP address of your device
  • Operating system (incl. language) of your device
  • Browser used
  • Approximate location during the retrieval
  • Name of your provider
  • Name and URL of the retrieved data
  • Language and version of the browser software

This data is processed in order to provide you with the best possible user experience and to improve our services, which is in our legitimate interests. A personalised user profile is not created.

2.2 Personal data used to provide services

If you use the registration or order forms on our website or enquire about our services and other offers by e-mail or telephone, we process your contact details and other relevant personal data. We process this personal data for the purposes of providing services and information about our services. This also applies to our social media presence, where we communicate with interested parties. The General Terms and Conditions (GTC) and terms of use as well as data protection declarations and other provisions of the individual operators of such platforms also apply in each case.

To answer your enquiries, we regularly require the following:

  • First name, name
  • Telephone number
  • E-mail address
  • If applicable, user name

To conclude and process contracts for fee-based services (e.g. advertising and business accounts), we require additional information, in particular information required by the regulations:

  • Field of activity, industry
  • Company size
  • Position and contact details of the applicant
  • Payment details, if applicable
  • etc.

We process your payments via various Swiss banks and various online payment service providers (Stripe and PayPal), from which we only receive transaction data such as the amount of the transaction, payment date and a payment confirmation. 3. Forms

GENERAL
We process contact and transaction data in order to conclude and fulfil a contract with you or to communicate with you about our activities as an umbrella organisation. Based on our legitimate overriding interest in informing you about new developments as well as offers and activities of the SHVF, we will send you corresponding digital information (e.g. petitions, info newsletters, e-mail notifications) if you are interested. You have the option to opt out of receiving such information at any time.

We use various forms on our website that you can fill out and send to us. Depending on the form, we require different data from you, whereby there is mandatory (marked with an *) and voluntary information. The mandatory information is required in order to be able to send you the requested information via the communication channel you have selected. The voluntary provision of further data (without *) enables us to address you more personally. We mainly offer the following forms:

3.2 Newsletter

If you would like to subscribe to our newsletter, the following information (* mandatory) is required. The other details are voluntary and enable us to address you more personally:

  • Salutation

  • E-mail address *

A few seconds after submitting your registration, a message will be sent to the e-mail address you provided. This contains a button with the text "Confirm registration". By clicking on this button, your registration will be activated. This procedure (double opt-in) ensures that no third-party or non-existent e-mail address has been entered.

We send our newsletters via our own web platform. Your personal data will not be passed on or sold to third parties.

3.3 Community

In the community area of the website, the sharing of all personal details can be managed individually via the privacy settings.

The setting can be found in the profile menu under "Manage Privacy".

The following options are available for sharing content:

  • Public
  • Registered persons (persons with a user account)
  • My friends (friends only)
  • Only me (private entry)
  • Customised

With "customised", content can be shared individually with users of your choice.

You can request an extract of all data linked to your person at any time. This information is made available for download as an archive. The processing time varies depending on the amount of data available. Once created, the archive is available for 14 days by clicking on the "Download" button in your user account.  To view your information, click on the "Download your information" link in your user account.

You can delete your profile at any time; you will find this option under "Edit profile" in the sidebar (left). Deleted profiles are initially deactivated and only completely deleted after 14 days.

  • User name
  • Password (for login)
  • E-mail address (for notifications)

All other details are optional.

3.4 Donations

We are happy to receive donations, as they help to finance the platform.

In order to thank you, we need your name and email address.

Your donation is processed via the online payment service provider PayPal, from which we only receive transaction data such as the amount of the transaction, payment date and a payment confirmation. 4. Cookies

Based on our legitimate interests, we use cookies on our website to provide you with the best possible experience and to obtain information to improve our services. When you visit our website, you will be asked to reject or accept cookies.

Cookies are small text files that are stored on your device (computer, laptop, tablet, smartphone or similar) with the help of the browser when you visit our website. Cookies do not cause any damage to your end device, nor can they execute programmes or contain viruses.

Most of the cookies we set are so-called session cookies. These are automatically deleted when you close the browser or end the transaction with our website (e.g. filling out a form). Other cookies remain stored beyond the usage process and enable us to recognise your preferences on your next visit (e.g. selection of the desired language).

Most browsers are set to accept cookies. If you do not want this, you can configure your browser so that it informs you about the setting of cookies and you can decide in each individual case whether you want to allow this or not. Furthermore, you can activate the automatic deletion of cookies, form data and temporary files when closing the browser and delete previously saved cookies at any time. 5. Google Analytics usage

This website uses Google Analytics, a web analytics service provided by Google Inc ("Google"). Google Analytics uses cookies to enable your use of our website to be analysed. The information generated by these cookies is usually transferred to a Google server in the USA and stored there. However, by activating IP anonymisation on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information for the purpose of analysing your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent the setting of cookies by selecting the appropriate settings on your browser. However, we would like to point out that in this case not all functions of this website can be used to their full extent. By using this website, you consent to the processing of data collected by Google in the manner and for the purposes set out above.

6. Usage of social media profiles

We maintain social media profiles on Facebook, X (formerly Twitter), Instagram, YouTube and LinkedIn. The data you enter on our social media sites will be published by the social media platform and will not be used or processed by us for any other purpose at any time. However, we reserve the right to delete content should this be necessary. We may communicate with you via the social media platform. This is based on your and our legitimate interest in communicating with each other in this way.

The operators of the social media platforms use web tracking methods. Web tracking, over which we have no influence, can take place regardless of whether you are logged in or registered with the social media platform.

7. Google Maps usage

Based on our legitimate interests, we use Google Maps to display our locations, a service provided by Google LLC based in Mountain View, USA or, if you are in Switzerland or the European Economic Area, Google Ireland Limited based in Dublin, Ireland ("Google").

By using Google Maps, information about your use of our website (including your IP address) may be transmitted to a Google server in Ireland and possibly in the USA and stored there. Google stores this data as usage profiles for the purposes of customising its services, advertising and market research. If you are logged in to Google at the same time as you visit our website, your data will be assigned directly to your Google account. If you wish to prevent this, you must first log out of your Google account. You can prevent the use of Google Maps by deactivating JavaScripts in your browser settings.  This can lead to functional restrictions when using our website.

8. Google reCAPTCHA

On our website we use the reCAPTCHA function of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, or if you are in Switzerland or the European Economic Area, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

The reCAPTCHA function is used to check whether data is entered on our website (e.g. in a form) by a human or by a bot (automated script). For this purpose, the behaviour of the website visitor is analysed using various criteria. reCAPTCHA evaluates information such as IP address, length of visit, mouse movements, duration and type of entries in form fields, etc. The data collected during the analysis is forwarded to Google.

9. Hosting

Our trusted hosting company is located in the heart of Zurich. Data security is a high priority for this contractual partner. Young4vintage has its own server infrastructure on which your data is backed up in encrypted form.

10. Disclosure to third parties

We treat your personal data confidentially and only pass it on if you have consented to this, if we are legally obliged or authorised to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from a contractual relationship.

In addition, we pass on your personal data to third parties if this is necessary or expedient in the context of the use of the website or for the provision of the services requested by you (including outside the website).

We may disclose your personal data to the following categories of recipients:

  • collaborators of the SHVF
  • Service providers (website support, hosting operation, etc.)
  • Authorities and courts

It goes without saying that the legal regulations on the transfer of personal data to third parties are complied with. If we use processors to provide our services, we take suitable legal precautions (order processing contracts) and appropriate technical and organisational measures to ensure the protection of your personal data in accordance with the relevant legal regulations.

If the level of data protection in a country in which the data is processed does not comply with the applicable data protection provisions, we contractually ensure that the protection of your personal data corresponds to that in Switzerland or the EU/EEA at all times, for example by including the EU standard contractual clauses.

11. Storage duration

We process and store your personal data only for the period of time required to achieve the purpose of storage or if this is provided for in laws or regulations to which we are subject. If the storage purpose no longer applies or if a prescribed retention period expires, your data will be routinely blocked or deleted in accordance with the statutory provisions.

12. Data security

We take technical and organisational security precautions to protect your personal data against manipulation, loss, destruction or access by unauthorised persons and to ensure the protection of your rights and compliance with the applicable data protection regulations.

The measures taken are intended to guarantee the confidentiality and integrity of your data and to ensure the availability and resilience of our systems and services when processing your data in the long term. They are also intended to ensure the rapid restoration of the availability of your data following a physical or technical incident.

Our security measures also include the encryption of your data. When your data is transmitted to us, it is encrypted using Transport Layer Security (TLS) / SSL. All information that you enter online is transmitted via an end-to-end encrypted connection. This means that this information cannot be viewed by unauthorised third parties.

Our e-mail traffic is transmitted in encrypted form in order to prevent unauthorised access or manipulation as far as possible. Our data processing and security measures are continuously improved in line with technological developments.

We also take our own internal data protection very seriously. Our employees and the service companies we commission are obliged to maintain confidentiality and comply with data protection regulations. Furthermore, they are only granted access to personal data to the extent necessary.

13. Your rights

Right to information
You have the right to request information from us as to whether and which of your personal data we process.

Right to rectification
You have the right to request that your inaccurate and possibly incomplete personal data be corrected or completed in our systems.

Right to erasure
You have the right to request that your personal data is deleted, e.g. if the data is no longer required for the purposes pursued. However, if we are obliged to retain your personal data due to legal or contractual obligations, we can only delete your personal data in these cases after the prescribed periods have expired.

Right to restriction of processing
You have the right to request that we restrict the processing of your personal data.

Right to data portability
You have the right to receive your personal data, which we process automatically on the basis of your consent or in fulfilment of a contract, in a structured, commonly used and machine-readable format or to request the transfer of this data to a third party. If you request the direct transfer of the data to another controller, this will only take place if it is technically feasible.

Right to object
You have the right to object to the processing of your personal data at any time in accordance with the legal requirements. In particular, you have the right to object to the processing of your personal data for the purpose of direct marketing.

Revocation of consent
You have the right to withdraw your consent to the processing of your personal data at any time, in principle with effect for the future.

Right of appeal
If you believe that the processing of your personal data violates data protection law or your data protection claims have otherwise been violated in any way, you can lodge a complaint with the competent supervisory authority (databreach.edoeb.admin.ch/report).

14. Changes to the privacy policy

We expressly reserve the right to amend or change this privacy policy at any time. All changes and additions are at the sole discretion of SHVF. The version published on our website in German (original) applies in each case.
